If you live and work the uk, But your work (writing) is to get published in the USA would you need a Visa? ?
Could you work for an american magazine whilst living in the uk (being a british citizen) without a visa?
and who do i pay taxes on my earnings to? just the uk? but if it it a us company that pays me?
also – if i go over maybe three times a year to meet with my editor, for less than a week each time, does that count as ‘working?’ i’m so confused!
If you live in the UK but your work is being published in and paid for by a US publisher, you have to pay US income tax on your US-source income. You will need an ITIN (Individual Taxpayer Identification Number) from the IRS. The nearest US consulate will have someone from IRS there to walk you through it. This assumes, of course, you are earning some “real” income from the US, not just one magazine article at a lousy $1000!
On the visa — Visa Waiver Program is for tourists. If you are coming to the US to conduct business, you need a business visa. If you are going to have to come to the US several times to spend a week with your editor or do a book promotion tour upon publication, you should obtain a multiple-entry business visa.
You do not need an employment visa since you still live and work in the UK, but are only coming here incidental to the actual writing you do at home. JK Rowling does not need an employment visa either, but you’d better believe she pays taxes!
